1. Acceptance of Terms
By accessing or using the HARK platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.
2. Description of Service
HARK provides an AI-powered phone receptionist service that answers calls, captures bookings, and handles customer enquiries on behalf of registered businesses. The service is provided on a subscription basis.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Free Trial
New accounts receive a 14-day free trial. A credit card is required to start your trial, but you will not be charged until the trial period ends. At the end of the trial period, you must maintain an active subscription to continue using the service. We reserve the right to modify or discontinue the trial offer at any time.
5. Subscriptions and Billing
Paid subscriptions are billed monthly in advance. All prices are in Australian dollars (AUD) and include GST where applicable. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
You may cancel your subscription at any time from the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
6. Acceptable Use
You agree not to use HARK to:
- Engage in fraudulent, deceptive, or misleading practices
- Violate any applicable laws or regulations
- Harass, abuse, or harm any person
- Interfere with or disrupt the integrity of the platform
- Attempt to reverse-engineer or extract the underlying AI models
7. Call Recording and Transcription
By using HARK, you acknowledge that calls handled by your AI assistant may be recorded and transcribed. You are solely responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including any requirement to notify callers that the call is being recorded.
8. Limitation of Liability
To the maximum extent permitted by law, HARK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
9. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance and will endeavour to provide advance notice where possible.
10. Termination
We reserve the right to suspend or terminate your account for violation of these terms, non-payment, or any activity that we determine poses a risk to other users or the platform.
11. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
