Refund Policy

1. Free Trial

HARK offers a 14-day free trial on all subscription plans. A credit card is required to start your trial, but you will not be charged during the trial period. Your first charge occurs only after your trial ends.

2. Monthly Subscriptions

After your free trial, HARK subscriptions are billed monthly in advance in Australian Dollars (AUD), inclusive of GST where applicable. You may cancel your subscription at any time from your account settings or by contacting us at rasoftwaredevelopment@gmail.com. Cancellation takes effect at the end of your current billing cycle, after which you will not be charged again.

3. No Refunds for Partial Months

As is standard practice for SaaS (software-as-a-service) subscriptions, HARK does not issue refunds for partial months. If you cancel mid-cycle, your access continues until the end of the billing period for which you have already paid, and no further charges will be made.

4. Service Failure Exception

We stand behind HARK. If the platform materially fails to function as described — for example, your AI assistant stops answering calls through no fault of your own configuration — please contact us at rasoftwaredevelopment@gmail.com within 7 days of the issue occurring. We will investigate and, at our discretion, may offer a pro-rata refund for the affected period. Each case is assessed individually and we will endeavour to reach a fair resolution promptly.

5. Australian Consumer Law

Nothing in this policy is intended to limit or exclude any rights or remedies you may have under the Australian Consumer Law (ACL), which forms Schedule 2 of the Competition and Consumer Act 2010 (Cth). You may be entitled to a remedy under the ACL for a major failure or if the service is not of acceptable quality. This policy applies in addition to, and does not override, your statutory rights.

6. How to Request a Refund

To submit a refund request or raise a billing concern, please email us at rasoftwaredevelopment@gmail.com with your account email address, a description of the issue, and the approximate dates affected. We aim to respond within 2 business days.

7. Governing Law

This Refund Policy is governed by the laws of New South Wales, Australia. Any disputes arising under this policy are subject to the exclusive jurisdiction of the courts of New South Wales.
